IMPORTANT NOTICE:

Before using the services provided by the undersigned, it is imperative that you thoroughly read and comprehend the following Terms and Conditions. Your agreement to these terms shall be deemed as evidence of your understanding and acceptance of the obligations and agreements set forth herein.

Bookl UK builds holiday let owners a website for their property. Bookl build functional websites without the need for any specific IT or graphic design knowledge, Bookl do it all for the holiday let proprietor. The platform offers three distinct Plans with varying levels of features, as described on the pricing page of the website.

Users of Bookl can choose between a monthly or yearly payment option and can unsubscribe at any time. The prices displayed on the platform are exclusive of VAT and intended for holiday let owners. The support and assistance services are available through online chat or by telephone during specific hours.

To sign up and purchase a bookl.travel website all Bookl users purchasing Bookl services must read and accept the General Terms and Conditions.

Bookl UK retains the right to change these terms at any time without prior notice.

Regular review of the terms is advised. The platform offers services referred to as “Bookl Services,” and users can access different levels of features through one of the three offered plans:

  • Standard
  • Premium
  • Enterprise (Coming soon)

Use of the platform and services implies acceptance of the terms.

To create an account, Bookl UKs must register on the website.

Support is available through online chat or by phone +44 7496 698 433 Monday to Friday, 9 am to 7 pm.

Bookl users can unsubscribe from a monthly payment plan at any time, but the subscription will automatically renew every month.

Prices for the services are available at bookl.travel/pricing, and exclude VAT.

Payment options include direct debit or credit card, and can be selected at the time of subscription. If payment is rejected, Bookl UK will make multiple attempts to process it before taking action.

Definitions

In these General Terms and Conditions, the following definitions apply to the words with initial capital letters:

“Bookl Service(s)” – refers to all services offered through the platform.

“Bookl UK” – refers to the company that operates the platform and can be found at bookl.travel

“Free website” – refers to the initial 100 free websites offered by Bookl UK. We reserve the right to reject building a free website.

“General Terms and Conditions” – refers to this agreement.

“Rules relating to personal data” – refers to the provisions regarding personal data outlined by The Information Commissioner’s Office (ICO) and upholds information rights in the public interest, promoting openness by public bodies and data privacy for individuals.

“Bookl UK” – refers to anyone who has access to one of the Bookl Services, whether they subscribed or not.

“Bookl UK Account” – refers to the personalised space assigned to the Bookl UK after registering on the platform.

“Bookl UK Content” – refers to all content added by the Bookl UK to their Bookl UK website.

“Bookl Page” – refers to the personal space accessible by the Bookl UK after registering on the platform.

“Bookl Website” – refers to the website created by the Bookl UK using the platform.

“Subscription” – refers to the contractual relationship between the Bookl UK and Bookl UK once the Bookl UK subscribes to a plan governed by these General Terms and Conditions.

“Team Member” – refers to any person authorised by the Bookl UK to access part or all of the Bookl UK Page with their own Bookl UK name and password.

Subscription time period

The Bookl UK can unsubscribe to a Subscription with no time commitment as long as the monthly payment invoicing option has been chosen.

Subscription is concluded for a period of one (1) month starting from the subscription date and is renewed tacitly from month to month. If Bookl UK simply wishes to change the Plan, the Bookl UK can do it at any time by contacting Bookl.

Price

The prices of the Services offered by Bookl UK are available on the Platform at the following URL address: https://www.bookl.travel/pricing

The prices displayed on the Platform exclude VAT, the Services offered by Bookl UK being intended for professionals.

Payment options

The Bookl UK will have to pay the subscription fee corresponding to the Plan chosen.

Payment incidents

If the payment is rejected, Bookl UK will try to proceed to the payment again three (3) days then five (5) days after the first rejection and then will try one last time fifteen (15) days after the first rejection.

In the event of this last attempt to charge failing again, Bookl UK retains the right to suspend the Bookl UK Account without any delay until the amount due is paid. The data loaded through the Bookl UK Account will be then kept for one (1) year.

All expenses, fines and other penalties that were applied and applicable by the entities that hold the credit cards passed on to Bookl and the Processor will be due by the Bookl UK and must be paid by the Bookl UK.

When a Bookl UK Account is terminated for non-payment, this could lead to a loss of the loaded data on the account, we take no responsibility for this and advise any content is backed up by the end user.
The Bookl UK is the sole accountable for saving all the loaded items on users Bookl UK Page.

Bookl’s obligations

General obligations

The Bookl UK is compelled to use the Platform according to these General Terms and Conditions and, more broadly, to all the legal provisions in force.

Bookl UK could modify or change the Platform and/or the Services. In the event of a substantial evolution or change, Bookl UK will inform the users with enough time before it becomes effective (the notice cannot be of less than three (3) months).

Intellectual property

The Platform

The Bookl UK recognises that Bookl UK is the unique holder of all the intellectual property rights pertaining to the Platform (and particularly every content of this one which would be protected by trade mark law and copyright).

As part of the Bookl UK Website creation, Bookl UK concedes to the Bookl UK a non-transferable Bookl UK license, on a non-exclusive basis, on the Platform for the entire world and the duration of the contractual relation.

The Bookl UK license conceded by Bookl UK only allows the Bookl UK to create users Bookl UK Website.

The Bookl UK renounces therefore to extract, represent, reproduce or more broadly cause damage to all or part of the Platform.

Bookl Website

Users agree that once a Bookl website has been created it cannot be moved from our servers and Bookl own the code and development that created the Bookl Website and thus cannot be transferred.

Taking bookings and insurance

Bookl does not cover insurance – As Bookl doesn’t take any commission and just offer a website build service this is not something covered in your subscription.

As a host you should have your own property insurance.

Verifying guests

Bookl takes no responsibility in verifying guests. As the guest will be contacting you directly you should verify your guests. We would suggest you ask a guest to send a copy of their driving license and passport.

If you have any doubts (or don’t want to take the responsibility) advise your guests books through your current platform or channel.

Handling Cancellations

Bookl does not get involved with handling cancellations.

As you are taking payments a guest will contact you directly if they want to cancel. You will have to refund the money by discussing with the guest. You can change your cancellation terms on your website.

Personal data

Collected data

As part of these General Terms and Conditions, Bookl UK may collect the following data:

  • identification data: title, name, surname, language and country, email address, mailing address, and phone number;
  • payment data: banking details (regarding this, we inform you that all payment transactions are encrypted by the receiving bank and that we do not keep any credit card number);
  • login details (such as your user name and password) and navigation data;
  • commercial data such as preferences.

Bookl UK is compelled not to transfer personal data to third parties

Cookies

Subject to the Bookl UK’s consent, Bookl UK uses cookies and other similar technologies to make the Bookl UK’s navigation on the Platform easier by adapting it to the equipment or to the search engine of the Bookl UK.

Cookies enable to collect different types of data:

  • details of use enabling Bookl UK to analyse how the Bookl UKs use the Platform;
  • technical data: IP address, search engine, localisation and time zone, browser plug-in, operating system, device used to login; and
  • information about the Bookl UKs’ visits on the Platform, including the URL addresses and their journey on it, the page response time, the errors of downloading.

Legal grounds

The Bookl UK’s personal data processing can have different legal grounds according to the cases.

Bookl UK is also based on other legal grounds such as the legitimate interests of the user.

Bookl UK takes particular care to respect the value placed in the consent in the Rules relating to personal data.

Duration of the data retention

Bookl UK keeps the personal data as long as the Subscription lasts and then one (1) year after that.

The right of deletion gives the opportunity to every Bookl UK to ask to Bookl UK to delete users personal data.

The personal data processing carried out from the Platform complies with the Rules relating to personal data.

Thus, regardless of the purpose or legal ground according to which we process your data, you can at any time and without any cost send us an email to get a recap of your rights at the following email address: support@bookl.uk

Please note however that we are not always able to answer positively to your request for legal reasons that we will inform you of, in this event, after receiving your request.

Security

Bookl UK has adequate security measures in order to prevent any loss, any non-authorised use or access, any modification or disclosure of the personal data.

All the personal data collected and processed by Bookl UK are saved on secure servers.

Bookl UK advise every Bookl host to only login on secure networks and to avoid login from public Wi-Fi networks.

Bookl UK’s commitments

Bookl UK is compelled to comply with the Rules relating to personal data for any collection or processing of this type of data that we would carry out through the Bookl UK Website.

In addition, the Bookl UK agrees to indemnify and hold harmless Bookl and companies affiliated with Bookl from any legal action or claim, loss, damage or liability (including reasonable attorney fees and costs of compliance with the above indemnification obligation) arising or results from any act of the Bookl UK. This indemnity obligation will survive the termination of this service contract, the parties being exonerated, all its subsidiaries, partners, affiliates, directors, officers, shareholders, lawyers, employees, representatives and agents.

Liability

Bookl UK cannot be regarded as an editor of the Bookl UK Content. If at anytime content needs changing then contact Bookl via support@bookl.uk

Even in the event of a breach, an error or insufficient diligence from Bookl UK, and whatever the grounds on which its liability is looked for, Bookl UK is accountable towards the Bookl UK as part of these General Terms and Conditions only for the direct damages, excluding indirect damages such as loss of an opportunity, loss or prejudice to the business reputation, loss of profit or expected saving, loss of customers, loss of turnover, whether these damages are foreseeable in their principle or scope or not.

In any case or based on any other legal basis, the maximum total liability of Bookl per calendar / year is limited to the total fees payable to Bookl by the user for the contracted services (excluding any billed transfer fees, such as interchange fees and registration fees imposed by entities holding credit card payment gateways) under this Agreement during the preceding full calendar year.

Bookl UK could only be held accountable if the Bookl UK gives proof of an error coming from Bookl UK in the meeting of its obligations, being understood that all parties recognise that Bookl UK’ error can only be connected to the infrastructural part it manages and on which it has control.

Bookl UK offers Services “as they are” and “as they are available”, and therefore does not have to make sure the Services match the Bookl UK’s needs.

Bookl UK does not guarantee the Platform and the Bookl UK Websites to operate perfectly but will put in its best efforts to ensure the continuity of the Services.

Bookl UK does not guarantee either the absence of any error or defect while using the Platform. In the event of receiving a notification of error or defect, Bookl UK is compelled, to the extent possible, to rectify it in a reasonable period of time.

Moreover, Bookl UK retains the right, voluntarily, to make the Platform unavailable in order to carry out any updating, improvement or maintenance operation.

If Bookl UK would be held accountable as part of these General Terms and Conditions, the right to compensation of the Bookl UK would be limited, from all the causes, to the price paid by the Bookl UK for the Services during the twelve (12) months previous to the fact generating the liability.

Subscription termination

Every Bookl UK can terminate users Subscription at any time by sending an email from the email corresponding to support@bookl.uk

The Subscription termination can be carried out at any time and without notice. Every deadline started will be due.

Any breach of these General Terms and Conditions could lead to the unilateral Subscription termination by Bookl UK as to the immediate suspension of the Bookl UK Account and Services to which the said Bookl UK has subscribed to.

Data restitution

As soon as the Subscription will be terminated, Bookl UK will revoke the access granted to the Bookl UK to users Bookl UK Account and is compelled to return to him/her, at the corresponding rate at the time of the reversibility notification, and when users first request is made in the form of a registered letter with an acknowledgement of receipt within no more than three (3) months following the termination of the Subscription, all users data in the form of SQL backup files and files of compressed documents in their native formats. At the end of this three (3) months period, no document or data can be transferred to the Bookl UK.

Bookl UK is compelled to keep a copy of the returned data only for backup ends and not to use them anymore for any other reason.

The Bookl UK will actively work together with Hosts in order to get users data back easily.
